1. Agreement to Terms
By renting the trailer from Connie Silvestri (“Lessor”), the Renter (“Lessee”) agrees to the following terms and conditions. These terms constitute a binding agreement between the Lessor and the Lessee.
2. Rental Period
The rental period begins on the date and time the trailer is collected and ends on the agreed return date and time. Late returns may result in additional charges.
3. Rental Fee and Deposit
The rental fee is payable upfront, along with a refundable deposit of AUD $50. The deposit will be returned to the Lessee upon the return of the trailer in the same condition it was rented, subject to any deductions for damages, repairs, or cleaning.
4. Trailer Condition
The trailer is provided to the Lessee in good working condition. It is the Lessee’s responsibility to inspect the trailer before use. Any existing damage must be reported to the Lessor prior to use. Failure to do so may result in the Lessee being held responsible for pre-existing damage.
5. Lessee Responsibilities
- The Lessee is responsible for the proper care, operation, and safety of the trailer during the rental period.
- The Lessee must use the trailer in accordance with all relevant road rules and safety regulations.
- The trailer must not be overloaded or used for any unlawful purposes.
6. Damage, Loss, or Theft
The Lessee is responsible for any damage to, or loss of, the trailer during the rental period, regardless of cause. This includes but is not limited to collision damage, theft, vandalism, and normal wear and tear beyond reasonable use.
7. Charges for Damages
- In the event of any damage, loss, or theft of the trailer during the rental period, the Lessee authorises the Lessor to charge the credit card on file for the cost of repairs or replacement.
- If the cost of repairs or replacement exceeds the AUD $50 deposit, the Lessee agrees that their credit card will be charged for the difference, without the need for additional authorisation.
8. Cleaning and Maintenance
The trailer must be returned clean and in the same condition as when it was rented. A cleaning fee may be deducted from the deposit if the trailer is returned excessively dirty or requires additional cleaning.
9. Insurance
The Lessee is responsible for ensuring that they hold adequate insurance coverage for the use of the trailer. The Lessor does not provide insurance coverage for the trailer or its contents while it is in the possession of the Lessee.
10. Indemnity
The Lessee agrees to indemnify and hold the Lessor harmless from any and all claims, liabilities, damages, costs, or expenses (including legal fees) arising from the use, operation, or possession of the trailer during the rental period.
11. Termination
The Lessor reserves the right to terminate the rental agreement at any time if the Lessee breaches any of these terms and conditions or if the Lessor believes the trailer is being used inappropriately.
12. Governing Law
This agreement is governed by the laws of Queensland, Australia, and any disputes arising under this agreement shall be subject to the exclusive jurisdiction of the courts of Queensland.
